Each type of structure has its characteristics and challenges
In Luxembourg law, there is a wide range of structures that meet various needs. Each has its characteristics, challenges, and requirements. We accompany you in your project, regardless of the category to which your company belongs. These different structures are classified as “regulated” and “non-regulated” by a supervisory authority. Regulated structures belong to the financial sector (CSSF – Commission de Surveillance du Secteur Financier) and the insurance sector (Commissariat aux assurances). They include:
- For funds: UCITS, FIS, SICAR, and Part II OPC. Some structures may be indirectly regulated by the CSSF. This is the case for FIAR, whose management body will be regulated by the CSSF.
- Other structures may be directly regulated by the CSSF depending on their intrinsic characteristics, such as securitization
- Finally, there are other non-regulated structures, except on a sectoral basis, such as Soparfi, SPF, SCSP, commercial companies, and civil companies
